Threats Of Legal Action And Garnishment

The payday loan industry uses some pretty questionable collection practices with their brick and mortar payday loan stores and the online companies can be downright brutal!

We have been told story after story of strong arm tactics using threats of legal action and garnishment to down right telling customers they would be stopping by borrowers houses to pick up a payment.

All these are simply scare tactics to get your money and you do not need to be afraid of these threats. instead, be proactive and remove them completely, and I will get into that option a bit later in this article.

Yes, but they would have to get a court to order it and this is not an easy thing to do in this industry.

Judges do not like to order people to pay on high-interest short term loans and the payday loan companies know this.

Thus, they will not start court proceedings unless it is a very last ditch attempt to collect the debt, and then most do not pursue it.

They also know most people in this situation can not pay to begin with!

The payday loan companies will just loose more money by taking you to court.

What they will do is drive you crazy!

What Happens?

The most aggressive payday loan companies threaten you and harass you with never ending calls to your home, work and references and they will say whatever it takes to get you to cough up money to them, including suggesting you borrow the moeny you owe them from friends, and they even suggest you pawn your valuables to pay them.

Their thinking is any money they can collect is pure profit and they are all about profit.

The longer they can hit your bank account, or when that fails, call you and threaten you to make payments, the more money they get.

They will offer you more loans to cover the current ones, threaten you with calling the cops, telling your spouse how much you owe, really, the sky is the limit for these guys!

You can report them to the Better Business Bureau but rarely do they get results, or you can check out our solution!

  1. Great information! Too many people get sucked into these loans and then can’t find a way out. I’ve never used a pay day loan but I have had experience with people using ridiculous tactics to get money from me. I was once called by someone that was totally scamming me and trying to collect on a debt that didn’t exist. THey said they would take me to court and I’d have to pay thousands. When I asked for proof of the debt he got REALLY mad but I didn’t back down. That was the last time I heard from them!

  2. Interesting topic, it is something new to me, in my country in Singapore. I am not sure that small loan from the non-banks is known as payday loan. Here usually, people who go for this small loan are gambler or individuals who are in real emergency need. I heard some of them also uses not so legal tactics to recover loans.

  3. Hey there Shawn,
    I have no experience dealing with loan companies but I would say I’m pretty experienced in spotting scammers. These loan companies are nothing more than loan sharks and I have many friends having bad experiences with them.

    Some of them even came to my friend’s house after his mother passed away and on the funeral day itself too! Very unethical way of doing business, its much better to have our own stream of income to rely on. Great article man, loved it.

Sounds like some of these payday loan companies are not much better than a sleazy loan shark but then again you have to expect that when you lend to people who need payday loans. things are very difficult nowadays with the high costs of living compared to ones wages sometimes we have no choice but its good to know if you get caught in a sticky situation with these guys their is avenues for help.   5. I used to be a paralegal working with debt collections. If the debt collections company keeps calling you all you have to do is tell them not to call your number any more and they have to comply. Most calls are recorded. If they continue calling your home then you have the right to report them.
    What you do have to worry about is that the debt may be sold off to another company and then that company takes further legal action leading to a judgement. When they get a judgement on you then they can garnish your wages, take money from your bank accounts and put liens on your assets. It’s best to avoid this of course so I would recommend to work with a debt consolidation company who will negotiate for you and get you back on track.

  6. Payday loans are a slippery slope, and sadly are a solution of last resort when murphy’s law rears its ugly head. You’ve got more month than money when you need a payday loan. And the expenses just keep coming. And then you are that much further behind on payday. Good reasoning about losing money to take people to court who can’t make the payments! I’ve never used a debt consolidation company and hope that I don’t have to. It’s good to know that there are reputable ones out there.

    This is a really cool article, I’ve been looking for this everywhere. Loans are helpful especially in businesses but I often dreaded the possibility of not being able to pay back my loan.

    Out of curiosity, is it okay if I make more loans just to pay back my existing one? I have a lot of friends doing that over and over again until their loans pile up but they keep borrowing like there’s no tomorrow.
