Texas Collection Laws

The very first thing you will notice when doing a Google search for “Texas Collection Laws” is besides this article you will pretty much only find companies who are trying to get you to take out payday loans.

This industry is shifty and they go for your pocketbook with a vengeance with zero regards for your well being and that to us is a real crime all by itself!

The problem with the Texas collection laws when regarding payday loan debt is they were written by the industry with many loopholes put in place. through corrupt “paid for” politicians by lobbyists for the payday loan industry.

The payday loan companies got these loopholes put there through corrupt “paid for” politicians who’s votes were boughten by lobbyists for the payday loan industry.

They pretty much wrote their own ticket so to speak.

While on the outside they look like they are written for the borrowers protection, they really protect the payday loan industry.

One Example Of Loopholes

The collection laws of Texas state the loan companies can not throw you in jail for your outstanding defaulted payday loan debt.

They state law clearly states that payday loans are civil contracts and thus subject to civil courts, meaning they payday loan companies may take you to court for repayment of your debt but they can not have you jailed for breaking any law.

Or can they?

Payday loan companies encouraged the passing of this law simply because they knew they could use it as a way of collecting defaulted payday loans.

They can threaten you with jail time when trying to collect the debt simply by turning in your post dated check to the authorities. because they have you post date a check for your loan and writing a worthless check in Texas is a crime.

Remember, they have you post date a check for your loan and writing a worthless check in Texas is a crime.

This is just one small example of how these companies twist the laws and the lawmakers to their advantage.

They spend millions of dollars a year getting laws passed that actually help them make huge profits off the backs of the poor and underprivileged!

  1. I owe a payday loan in texas, I been paying on it but then came across hard times…they reported it to court and i was making payments again..this last payment I couldn’t make and now they are threatening me. What are my options?

  2. I took out a title loan with the understanding that I would not pay a penny of interest for the first 30days but when I when in to make a payment on the loan they had lied about not having to pay any interest and I had to pay 180 dollars of interest at 20% so they lied to me at Texas car title and pay day loans.

  3. Ahh, that’s so awful that they can catch you out by having you write a post-dated check and then sending your check to the authorities. That’s a really bad underhanded tactic and just confirms that these payday loan companies do not care about people at all. Their only concern is getting money by screwing people over when they are at their most vulnerable. Payday loans should be made illegal, don’t you think?

    1. Hi, Marcus!

Yes, I do believe they should be illegal and that is actually happening in some places.

Online payday loans are now illegal in several states and hopefully, others will follow suit!

Until they are outlawed everywhere we will be here helping people in any way we can!

  5. I think payday loans worldwide are a terrible thing. In the UK. It is illegal for people to run private loan companies, I think in the states. It’s called loansharking as well. The trouble is that now you have legal and I use that term loosely companies charging rates that are as bad as loan sharks and yet they are legal. So I hope you can help all those poor folk in Texas!

    1. Hi, Donald!

Yes, these companies are just legal versions of back alley loan sharks and anything we can do to help people get rid of them is fair game!

      Thanks for stopping by!
